Welcome to GymBeat. These Terms of Service ("Terms") govern your access to and use of the GymBeat mobile application.
By using GymBeat, you agree to these Terms. If you do not agree, please do not use the App.
Acceptance of Terms
By creating an account or using GymBeat, you confirm that:
- You are at least 13 years of age
- You have the legal capacity to enter into binding agreements
- You will comply with all applicable laws and regulations
- All information you provide is accurate and truthful
Account Registration and Security
2.1 Account Creation
To use GymBeat, you must create an account using a valid email address or through supported OAuth providers (Google).
2.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
2.3 Account Termination
We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.
User Content and Data
3.1 Your Content
You retain ownership of all content you submit to GymBeat, including profile photos, fitness data, and personal information.
3.2 License to Use Your Content
By submitting content, you grant us a limited, non-exclusive license to use, store, and display your content solely for the purpose of providing the Service.
3.3 Content Restrictions
You agree NOT to upload or submit:
- Illegal, harmful, or offensive content
- Content that violates others' intellectual property rights
- Malware, viruses, or malicious code
- Spam or misleading information
Permitted Use
You may use GymBeat for:
- Tracking your fitness progress and goals
- Logging nutrition, meals, and calorie intake
- Scanning food barcodes for nutrition information
- Finding and browsing gyms near you
- Saving favorite gyms
- Syncing health data with Apple HealthKit or Google Health Connect
- Personal, non-commercial purposes
4.1 Prohibited Use
You may NOT:
- Use automated systems (bots, scrapers) to access the App
- Reverse engineer, decompile, or disassemble the App
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the App's functionality
- Use the App for any illegal or unauthorized purpose
- Impersonate others or misrepresent your affiliation
Health and Fitness Disclaimer
IMPORTANT NOTICE
GymBeat is a fitness and nutrition tracking tool, NOT a medical device, dietitian, or health advisor.
- Consult a physician before starting any fitness or diet program
- TDEE and calorie recommendations are estimates, not medical advice
- Nutrition data from OpenFoodFacts may contain inaccuracies
- Always verify nutrition information on food packaging
- Consult a registered dietitian for specific dietary needs or restrictions
- We are not responsible for health outcomes based on app usage
- Stop using the app and seek medical help if you experience adverse effects
By using GymBeat, you acknowledge that you are solely responsible for your health, fitness, and dietary decisions.
Location Services
GymBeat uses your location to show nearby gyms and calculate distances. Location data:
- Is only collected when you use the App ("When In Use")
- Is NOT tracked in the background
- Is stored temporarily and cleared when you close the app
- Can be disabled in your device settings (some features may not work)
You can revoke location permissions at any time through your device settings.
Intellectual Property
All rights, title, and interest in GymBeat (including design, code, logos, and content) are owned by GymBeat or our licensors.
- The GymBeat name and logo are our trademarks
- You may not copy, modify, or distribute our intellectual property
- Third-party gyms and facilities retain ownership of their names and images
Third-Party Services and Links
GymBeat uses third-party services (Clerk, Convex, ipapi.co, Expo, OpenFoodFacts) to operate. These services have their own terms and privacy policies.
Nutrition data is provided by OpenFoodFacts, a community-driven database. This data is provided "as-is" and may not be 100% accurate. Always verify nutrition information on the actual food packaging.
We may provide links to third-party gyms or websites. We are not responsible for their content, terms, or privacy practices.
8.1 Health Platform Integrations
GymBeat offers optional integrations with Apple HealthKit (iOS) and Google Health Connect (Android):
- You must explicitly authorize GymBeat to read and/or write health data
- GymBeat may read steps, calories, heart rate, and sleep data to enhance your fitness tracking
- GymBeat may write weight data back to your health platform when you log weight
- You can disconnect health integrations at any time from Settings
- When you disconnect or delete your account, GymBeat stops accessing your health data. Data previously written to your health platform remains on your device
8.2 Sponsored Content
GymBeat may display sponsored content from partner brands:
- Sponsored content is clearly labeled as "Sponsored" within the app
- Sponsored content may include links to external websites operated by our partners
- We track clicks on sponsored content for aggregated performance analytics
- No personal information is shared with sponsored content partners — they only receive anonymized, aggregated metrics
Disclaimer of Warranties
GymBeat is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
We do NOT warrant that:
- The App will be uninterrupted, secure, or error-free
- Gym information will always be accurate or up-to-date
- Location services will always work correctly
- The App will meet all your requirements
Use of the App is at your own risk. We recommend verifying gym information directly before visiting.
Limitation of Liability
To the maximum extent permitted by law, GymBeat shall NOT be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Personal injury or health issues arising from app use
- Damages from third-party services or gyms
- Unauthorized access to your account
Our total liability to you shall not exceed the amount you paid to use the App in the past 12 months (currently $0, as the App is free).
Indemnification
You agree to indemnify and hold harmless GymBeat from any claims, damages, or expenses (including legal fees) arising from:
- Your violation of these Terms
- Your use or misuse of the App
- Your violation of any laws or third-party rights
- Content you submit to the App
Service Availability
We reserve the right to:
- Modify, suspend, or discontinue the App at any time
- Change features or functionality without notice
- Perform maintenance and updates
- Remove or restrict access to certain features
We are not liable for any service interruptions or changes.
Pricing and Payments
GymBeat is currently a free app. If we introduce paid features or subscriptions in the future:
- Pricing will be clearly displayed before purchase
- Payments will be processed through Apple App Store or Google Play Store
- Refund policies will follow App Store/Play Store guidelines
- Existing users will be notified of pricing changes
Dispute Resolution
14.1 Informal Resolution
If you have a dispute, please contact us at support@gymbeat.app first. We will try to resolve it informally within 30 days.
14.2 Arbitration
If informal resolution fails, disputes will be resolved through binding arbitration rather than in court, except where prohibited by law.
14.3 Class Action Waiver
You agree to resolve disputes individually, not as part of a class action or collective proceeding.
Governing Law
These Terms are governed by the laws of Romania, without regard to conflict of law principles. For EU users, you retain the protections of your local consumer protection laws.
Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by:
- Updating the "Last Updated" date
- Sending an in-app notification
- Sending an email to your registered address
Your continued use of GymBeat after changes become effective constitutes acceptance of the new Terms. If you disagree, you must stop using the App.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and GymBeat regarding the use of the App.
Community Guidelines
GymBeat is committed to maintaining a safe and supportive fitness community. By using our social features, you agree to follow these guidelines:
19.1 Prohibited Content
The following content is not allowed:
- Harassment, bullying, threats, or hate speech
- Explicit, violent, or inappropriate content
- Spam, promotional content, or misleading information
- Content promoting dangerous activities or eating disorders
- Personal attacks or targeted harassment of other users
- Impersonation or misrepresentation
19.2 Automated Content Moderation
To maintain a safe community, we use automated systems to screen user-generated content before it is published. This includes:
- Text content (posts, reviews, chat messages) checked for harmful content
- Images (posts, profile photos, gym/equipment photos) checked for objectionable material
Content that violates our guidelines will be automatically rejected. This helps prevent harmful content from ever appearing in the app.
19.3 Reporting Content
If you see content that violates these guidelines, you can report it using the report feature on any post or review. All reports are reviewed within 24 hours.
19.4 Blocking Users
You can block users whose content you don't want to see. Blocked users won't appear in your feed and won't be able to interact with you.
19.5 Consequences
ENFORCEMENT
Violations may result in content removal, warnings, temporary suspension, or permanent account termination depending on severity.
- First violation: Content removal and warning
- Repeated violations: Temporary account suspension
- Severe or persistent violations: Permanent account termination
We reserve the right to remove any content and take action against accounts at our sole discretion.
