Acceptance of Terms

By creating an account or using GymBeat, you confirm that:

• You are at least 13 years of age and, if the law of your country requires it at your age (in Romania, under 16), you have the permission of a parent or guardian
• You have the legal capacity to enter into binding agreements, or your parent or guardian accepts these Terms on your behalf
• You will comply with all applicable laws and regulations
• All information you provide is accurate and truthful

Account Registration and Security

2.1 Account Creation

To use the App, you must create an account with a valid email address and password, or through Sign in with Apple, Google or Facebook.

2.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

2.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

You can delete your account at any time from Settings → Delete Account (see Section 11 of the Privacy Policy). If you have an active paid subscription, cancel it with Apple or Google first — deleting your account does not cancel a store subscription.

User Content and Data

3.1 Your Content

You retain ownership of all content you submit to GymBeat, including workouts, nutrition logs, photos, posts, reviews, chat messages and personal information.

3.2 License to Use Your Content

By submitting content, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process and display it solely to operate and provide the Service. This includes showing content you choose to share to other users, letting other users import workout templates, meals or recipes you share, and sending content to our service providers (such as AI and moderation providers) as described in the Privacy Policy. The license ends when you delete the content or your account, except for copies other users have already imported into their own libraries.

3.3 Content Restrictions

You agree NOT to upload or submit:

• Illegal, harmful, or offensive content
• Content that violates others' intellectual property rights
• Malware, viruses, or malicious code
• Spam or misleading information

Permitted Use

You may use GymBeat for:

• Logging workouts, nutrition, weight and progress photos, and tracking your goals
• Logging meals with barcode scans, food search and AI meal-photo analysis
• Receiving AI Coach workouts, session reviews, weekly recaps and multi-week Coach Plans
• Finding gyms, reviewing gyms and equipment, and joining gym chats
• Sharing workouts and meals with the community
• Syncing health data with Apple Health or Google Health Connect
• Viewing your data in home-screen widgets and the workout Live Activity
• Personal, non-commercial purposes

4.1 Prohibited Use

You may NOT:

• Use automated systems (bots, scrapers) to access the App or Website
• Reverse engineer, decompile, or disassemble the App
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the functionality of the App or Website
• Use GymBeat for any illegal or unauthorized purpose
• Impersonate others or misrepresent your affiliation
• Abuse free trials, discount codes or free-tier limits, for example by creating multiple accounts

Health and Fitness Disclaimer

• Consult a physician before starting any fitness or diet program
• Do not use GymBeat as a substitute for professional advice if you are pregnant, have a medical condition or injury, or have a history of eating disorders
• Calorie and macro targets, goal dates and weight projections are estimates based on standard formulas and the pace you choose — not medical advice. Real results vary
• Nutrition data from food databases and AI photo analysis may contain inaccuracies
• AI meal-photo estimates can be wrong about foods, portions and macros — review them before saving, and check the actual food packaging when accuracy matters
• Consult a registered dietitian for specific dietary needs or restrictions
• AI Coach workouts, loads, progressions, reviews and recaps are generated by software, not by certified personal trainers, and are informational only
• Use your own judgment: lower or skip a suggested load if it feels unsafe, and consult a qualified trainer when needed
• We are not responsible for health outcomes based on app usage
• Stop using the app and seek medical help if you experience adverse effects

By using GymBeat, you acknowledge that you are solely responsible for your health, fitness, and dietary decisions.

Location Services

GymBeat uses your location to show nearby gyms and calculate distances. Location data:

• Is only used while you use the App ("While Using the App")
• Is NOT tracked in the background or kept as a location history
• Is used only for the request that needs it and is not stored
• Can be disabled in your device settings (the map will then use an approximate location or a city you choose)

You can revoke location permissions at any time through your device settings.

Intellectual Property

All rights, title, and interest in GymBeat (including design, code, logos, and content on both the App and the Website) are owned by GymBeat or our licensors.

• The GymBeat name and logo are our trademarks
• You may not copy, modify, or distribute our intellectual property
• Third-party gyms and facilities retain ownership of their names and images

Third-Party Services and Links

GymBeat relies on third-party services to operate — including Clerk, Convex, OpenAI, Sightengine, RevenueCat, Sentry, Axiom, Expo, Meta, Apple, Google and Vercel (the Privacy Policy lists them all). These services have their own terms and privacy policies.

Nutrition data comes from Open Food Facts, our curated database of common foods, and AI estimates. This data is provided "as-is" and may not be 100% accurate. Always verify nutrition information on the actual food packaging when accuracy matters.

We may provide links to third-party gyms or websites. We are not responsible for their content, terms, or privacy practices.

8.1 Health Platform Integrations

GymBeat offers optional integrations with Apple Health (iOS) and Google Health Connect (Android):

• You must explicitly authorize GymBeat to read and/or write each type of health data
• GymBeat may read steps, active calories, heart rate and sleep to show your daily metrics and inform the Coach's weekly recap
• GymBeat may write the weight you log and the workouts you complete back to your health platform
• You can change or disconnect health integrations at any time from Settings
• When you disconnect or delete your account, GymBeat stops accessing your health data. Data previously written remains on your device

8.2 Sponsored Content

GymBeat may display sponsored content from partner brands:

• Sponsored content is clearly labeled as "Sponsored" within the app
• Sponsored content may include links to external websites operated by our partners
• We track clicks on sponsored content for aggregated performance analytics
• No personal information is shared with sponsored content partners — they only receive anonymized, aggregated metrics

8.3 AI-Powered Features

GymBeat uses OpenAI models to power the AI Coach and meal-photo analysis:

• The AI Coach uses your training, nutrition, weight and (if connected) health data to explain workouts, session reviews and weekly recaps
• Meal-photo analysis estimates foods, portions and macros from your photo
• Only the data each feature needs is sent, without your name or email (see the Privacy Policy)
• AI outputs are best-effort estimates, not professional advice, and may be inaccurate
• Free accounts can use a limited number of Coach workouts, Coach reviews and AI meal scans, as shown in the App; PRO removes these limits

Disclaimer of Warranties

We do NOT warrant that:

• The App or Website will be uninterrupted, secure, or error-free
• Gym information will always be accurate or up-to-date
• Location services will always work correctly
• AI-generated estimates, suggestions and projections will be accurate
• The App will meet all your requirements

Use of the App is at your own risk. We recommend verifying gym information directly before visiting.

Limitation of Liability

To the maximum extent permitted by law, GymBeat shall NOT be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Personal injury or health issues arising from app use
• Damages from third-party services or gyms
• Unauthorized access to your account

Our total liability to you shall not exceed the amount you paid to use the App in the past 12 months.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including your statutory rights as a consumer.

Indemnification

You agree to indemnify and hold harmless GymBeat from any claims, damages, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use or misuse of the App or Website
• Your violation of any laws or third-party rights
• Content you submit to the App

Service Availability

We reserve the right to:

• Modify, suspend, or discontinue the App or Website at any time
• Change features or functionality without notice
• Perform maintenance and updates
• Remove or restrict access to certain features

We are not liable for any service interruptions or changes.

Pricing and Payments

GymBeat has a free tier and a paid subscription, GymBeat PRO. The free tier includes unlimited workout, nutrition and weight logging and the community features, with limited use of the AI features (Coach workouts, Coach reviews, AI meal scans) and of saved templates, meals and recipes. GymBeat PRO removes these limits and unlocks premium features such as the full weekly recap and template folders.

13.1 Plans and Prices

• GymBeat PRO is available as a monthly or a yearly auto-renewing subscription
• The exact price, billing period and any free trial are shown in the App and on the App Store or Google Play purchase sheet before you confirm
• For reference, in Romania GymBeat PRO costs 34.99 lei per month or 259.99 lei per year; a partner discount code can lower this price (see 13.6). In other countries the store sets prices in your local currency; they may differ and include any taxes the store applies
• Lifetime access is no longer sold. Existing lifetime purchases remain valid and can be restored on a new device with "Restore Purchases"

13.2 Free Trial

• New subscribers may be offered a 14-day free trial on the monthly or the yearly plan. Eligibility is determined by Apple or Google — for example, a trial may be available only once per Apple ID or Google account
• Nothing is charged during the trial. Unless you cancel at least 24 hours before the trial ends, it converts automatically into the paid plan you selected, at the price shown when you started it
• When a trial starts, the App schedules a reminder notification two days before it converts (if notifications are allowed on your device)
• When you set up a new account, the App may ask you to start a free trial — or purchase a subscription or restore a purchase — before continuing. The trial is free and can be cancelled at any time; if you are not eligible for a free trial, this step can always be skipped

13.3 Billing and Auto-Renewal

• Payments are processed by the Apple App Store or Google Play and charged to your store account at confirmation of purchase or, with a free trial, when the trial ends
• Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the period ends
• Your store account is charged for renewal within 24 hours before the end of the current billing period
• If a renewal payment fails, Apple or Google will retry it. During a grace period of up to 3 days you keep PRO access; if the payment is still not collected, PRO ends and your account returns to the free tier

13.4 Cancellation

• You can cancel at any time in your App Store or Google Play subscription settings (the App's Subscription screen links there)
• Cancellation takes effect at the end of the current billing period — you keep PRO access until then
• No partial refunds are given for unused portions of a billing period, except where required by law or granted by the store
• When PRO ends, your account returns to the free tier. Your data is kept; saved items above the free limits are hidden until you subscribe again

13.5 Refunds

• Purchases are processed by Apple or Google, so refund requests — including any statutory right of withdrawal under consumer law — are handled by them under their policies
• GymBeat does not process payments directly and cannot issue refunds — please contact Apple Support or Google Play Support

13.6 Partner Discount Codes

• Partners such as coaches, gyms and creators may hand out discount codes
• A code lets you subscribe to GymBeat PRO at a discounted price, shown in the App and on the App Store or Google Play purchase sheet before you confirm. The discounted plans are regular store subscriptions — the free trial, billing, auto-renewal and cancellation work as described in 13.2–13.4
• Each account can apply only one code
• The discount applies to subscriptions bought after you apply the code; it does not change the price of a subscription you are already paying for
• The discounted price is kept across the renewals of the subscription bought with the code, for as long as that subscription stays active, subject to 13.7
• The partner whose code you used may receive a commission on your subscription; this does not change your price
• Codes have no cash value, cannot be sold or exchanged, and may be deactivated. Deactivating a code does not change the price of a subscription already bought with it
• Under the previous terms, a code redeemed in an earlier version of the App could instead give a time-limited free PRO trial; such trials end automatically and are never charged

13.7 Price Changes

• We may change subscription prices
• Price changes never affect a billing period you have already paid for
• Apple or Google notify you in advance as their rules require and, where required, ask for your consent before a price increase applies; you can cancel before the new price takes effect

Dispute Resolution

14.1 Informal Resolution

If you have a dispute, please contact us at support@gymbeat.app first. We will try to resolve it informally within 30 days.

14.2 Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration rather than in court, except where prohibited by law.

14.3 Class Action Waiver

You agree to resolve disputes individually, not as part of a class action or collective proceeding, except where prohibited by law.

If you are a consumer in the EU, nothing in this section prevents you from bringing a claim before the competent courts of your country of residence or from contacting a consumer protection authority (in Romania, ANPC).

Governing Law

These Terms are governed by the laws of Romania, without regard to conflict of law principles. For EU users, you retain the protections of your local consumer protection laws.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Updating the "Last Updated" date
• Sending an in-app notification
• Sending an email to your registered address

Your continued use of GymBeat after changes become effective constitutes acceptance of the new Terms. If you disagree, you must stop using the App and Website.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GymBeat regarding the use of the App and Website.

Community Guidelines

GymBeat is committed to maintaining a safe and supportive fitness community. By using our social features, you agree to follow these guidelines:

19.1 Prohibited Content

The following content is not allowed:

• Harassment, bullying, threats, or hate speech
• Explicit, violent, or inappropriate content
• Spam, promotional content, or misleading information
• Content promoting dangerous activities or eating disorders
• Personal attacks or targeted harassment of other users
• Impersonation or misrepresentation

19.2 Automated Content Moderation

To maintain a safe community, we use automated systems to screen user-generated content before it is published. This includes:

• Text — post captions, gym and equipment reviews, and gym chat messages — checked for harmful content
• Images — profile, post, recipe, gym and equipment photos — checked for objectionable material

Content that violates our guidelines will be automatically rejected. This helps prevent harmful content from ever appearing in the app.

19.3 Reporting Content

If you see content that violates these guidelines, you can report it using the report option on posts, reviews, photos and chat messages. All reports are reviewed within 24 hours.

19.4 Blocking Users

You can block users whose content you don't want to see. Blocked users and their posts are hidden from your feeds, follower lists and user search.

19.5 Consequences

• First violation: content removal and warning
• Repeated violations: temporary account suspension
• Severe or persistent violations: permanent account termination

We reserve the right to remove any content and take action against accounts at our sole discretion.
